Our terms and conditions for using IMR System

Agreement to Terms

By accessing or using the IMR System website and "What's My Color" personality assessment application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

IMR System, LLC ("we," "us," or "our") is an Arizona limited liability company that operates the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement.

Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems (bots, scrapers) without permission
  • Impersonate others or provide false information
  • Upload malicious code or viruses
  • Violate any applicable laws or regulations

Payment Terms

Subscription Services

  • Fees are charged in advance on a recurring basis
  • Payments are processed securely through Stripe
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • Failure to pay may result in account suspension or termination

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

Intellectual Property

The Service, including all content, features, and functionality, is owned by IMR System, LLC and is protected by copyright, trademark, and other intellectual property laws.

Your Assessment Data: You retain ownership of your assessment responses and results. By using the Service, you grant us a license to use this data to provide the Service and improve our offerings.

Our Content: You may not copy, modify, distribute, or create derivative works from our content without written permission.

Assessment Disclaimer

The personality assessment provided by the Service is for informational and entertainment purposes only. It is not:

  • Professional psychological or medical advice
  • A diagnostic tool for mental health conditions
  • A substitute for professional counseling or therapy
  • Guaranteed to be accurate or complete

You should not make important life decisions based solely on assessment results. Consult qualified professionals for serious personal, medical, or psychological matters.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results will be accurate or reliable
  • Defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMR SYSTEM, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or similar harmful code
  • Any errors or omissions in content
  • Any user content or conduct

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless IMR System, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes must be resolved in the state or federal courts located in Arizona.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at support@imrsystem.com to attempt to resolve the dispute informally.

Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Arizona. You waive the right to a jury trial and to participate in class actions.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

Changes to Terms

We may modify these Terms at any time by posting updated Terms on this page with a new "Last Updated" date. Material changes will be communicated via email or notice on the Service.

Your continued use after changes take effect constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IMR System, LLC regarding the Service.
